Rink Fries Inc. ("Rink Fries", "we", "us", or "our") operates the Rink Fries platform. The platform allows you to order food and drinks from a vendor and pay for them, and it allows the vendor to manage those orders. A vendor is a canteen at a rink or venue, a food truck, or another independent seller that takes orders through Rink Fries. Rink Fries is a Nova Scotia company. These Terms of Service (the "Terms") form the agreement between you and Rink Fries when you use the platform. They are written to be read in one sitting.
If you sell on Rink Fries, the Vendor Agreement also applies to you, and it governs where the two differ.
Summary
- The Rink Fries platform is the ordering and payment system. The vendor prepares your food and is responsible for it.
- Payment is taken when you place your order. An order that has not been paid for has not been placed.
- Refunds are decided by the vendor. When a vendor refunds you, the money is returned to the card you paid with. The one exception is a pre-order, which you may cancel yourself before its cutoff for an automatic refund.
- The person who enters a card at checkout is responsible for the order. Rink Fries cannot see who is holding the card.
- Prices, taxes, fees, and any tip are displayed before you pay. The total you see is the total you are charged.
- Deal honestly with Rink Fries and with the vendors, and do not use the platform to cause harm.
- Our responsibility to you is limited to the amount you paid through Rink Fries for the order in question.
1. Who These Terms Apply To
These Terms apply to everyone who uses Rink Fries, whether you order as a guest, create an account, or work for a vendor. By placing an order, creating an account, or using the site, you accept these Terms. If you do not accept them, please do not use Rink Fries.
Rink Fries is intended for adults. If you are under the age of majority in your province, use Rink Fries only with a parent or guardian, and see section 5 regarding cards.
2. What Rink Fries Is and Is Not
Rink Fries is a technology platform. It displays a vendor's menu, takes your order, sends it to the vendor, collects your payment, and notifies you when the order is ready.
Rink Fries is not a restaurant, a caterer, a food provider, or a delivery company. Each vendor is an independent business. The vendor sets its own menu and prices, prepares the food, manages allergens and food safety, decides how it fulfils orders, and provides customer service for what it sells. Rink Fries does not inspect vendor kitchens and does not verify menu descriptions, ingredient lists, or allergen information.
3. Ordering
3.1 Placing an Order
You select your items and options, add any special instructions, choose how you wish to receive the order, and pay. Your order is placed when your payment succeeds. Until that point, the vendor has not seen the order and nothing has been charged.
If you leave checkout without paying, the order is not placed. We hold an unpaid order for a short time in case you return to complete it, after which we mark it abandoned. An abandoned order is never charged.
3.2 Receiving Your Order
At checkout you choose pickup or a delivery method the vendor offers, such as delivery to a seat, a table, a parking spot, or an address. You are responsible for the details you enter. If a section, row, seat, table number, or address is incorrect, the vendor may be unable to locate you and may be unable to complete the order.
The vendor decides which delivery methods it offers and where it will deliver. Any delivery fee is displayed before you pay.
3.3 Timing and Availability
Wait times displayed on the site are estimates based on how long the vendor has recently taken. They are not promises. A vendor may run out of an item, may be unable to fill an order because of volume or a problem in the kitchen, or may need to cancel an order. In that case the vendor will cancel the order and section 6 applies.
3.4 Your Instructions
Special instructions are passed to the vendor as you typed them. The vendor will do its best, but it is not required to follow an instruction it cannot safely or reasonably carry out. Do not rely on a special instruction to manage an allergy. Speak to the vendor directly.
3.5 Pre-Orders
Some vendors allow you to order ahead for a pickup window, such as an intermission or a later time. You pay when you place a pre-order, as with any other order. Each window has a cancellation cutoff set by the vendor. Until that cutoff, and provided the vendor has not started preparing your order, your order page offers a Cancel pre-order button. Using it cancels the pre-order and the payment is refunded automatically, apart from any gift card part, which section 6.3 covers. If a vendor cancels a pickup window, the pre-orders in it that are not yet made are cancelled and refunded.
4. Prices, Taxes, Fees, and Tips
- Prices are set by the vendor and are displayed in Canadian dollars.
- Taxes are charged at the rate that applies to the vendor's location and are shown as a separate line.
- Service fee. The service fee is Rink Fries' fee for the platform. It is a percentage of your item prices as shown, after any discount, plus any delivery fee. The rate is set for each vendor and may be zero. It is shown on its own line before you pay, and tax applies to it as the law requires.
- Delivery fee. If you choose delivery to an address, a delivery fee may apply and is displayed before you pay.
- Tip. You may add a tip for the vendor at checkout. A tip is optional, is not taxed, and no service fee is charged on it.
- Discounts and coupons. A vendor may offer a discount or a coupon code. Each has its own conditions, such as a minimum order, a limit on the number of times it may be used, or an expiry date, and the vendor may withdraw it. A discount that cannot be applied at checkout is not owed to you.
The total displayed on the payment page is the amount charged to your card. If a price on the site is clearly a mistake, the vendor may cancel the order rather than fill it at that price and refund you in full.
5. Payment and Cards
5.1 How Payment Works
Payments are taken by one of our payment providers, whichever the vendor uses. When you pay, you enter your card in the provider's secure payment form, either on the provider's own page or within our checkout. Your card number goes to the provider and never to Rink Fries. We keep a payment reference, the amount, and the status so that we can match the payment to your order and process a refund if one is needed.
By paying, you authorise the provider to charge your card for the total shown, and you confirm that you are permitted to use that card.
If the provider is unavailable, payment may fail or be delayed. Rink Fries is not responsible for an outage at the provider or at your card issuer, but we will help you resolve any order affected by one.
5.2 Responsibility for a Card
The person who enters a card at checkout is responsible for the order placed with it. Rink Fries cannot see who is holding the card or entering its details. If you are the cardholder, you are responsible for orders placed with your card by members of your household or people in your care, including children. Keep your card details and your Rink Fries account to yourself.
If you believe your card has been used on Rink Fries without your permission, contact your card issuer immediately and then email [email protected] so that we can help the vendor locate the order.
5.3 Chargebacks
If you have a problem with an order, ask the vendor first, then Rink Fries. A chargeback raised without first requesting a refund, or a chargeback for an order that was delivered as described, may result in your account being suspended. If a chargeback is disputed, we will provide the order records to the provider and to your card issuer.
6. Cancellations and Refunds
6.1 Who May Cancel
Once your order has been paid for, you cannot cancel it yourself on the site, because the vendor may already be preparing it. The exception is a pre-order, which you may cancel yourself as described in section 3.5. For any other order, if you need to cancel, contact the vendor immediately. The vendor can cancel an order at any point before it is complete.
A vendor may cancel your order if it cannot fill it, for example because an item has run out, the kitchen is closed, or the delivery details cannot be found. Cancelling an order does not by itself move any money. When a vendor cancels an order you have paid for, the vendor, or Rink Fries where the fault was the platform's, issues the refund as a separate step, and section 6.3 describes how it reaches you.
6.2 Who Decides on a Refund
The vendor decides whether to refund an order, in full or in part, and it does so through Rink Fries. Rink Fries does not decide refunds for vendors. Where a problem was caused by the platform itself, we may issue the refund ourselves on the vendor's behalf. A pre-order you cancel before its cutoff, or one in a pickup window the vendor cancels, is refunded automatically.
A vendor may refund the whole order or only some of the items on it. A refund of part of an order returns those items, less their share of any discount, plus the tax on them and their share of the service fee. A tip and any delivery fee are returned only when the whole order is refunded. A refund can never be for more than you paid.
6.3 How a Refund Reaches You
A refund is returned to the card you paid with, through the provider. We send you an email when a refund is issued. How long it takes to appear on your statement depends on your card issuer and is normally a few business days. We cannot refund to a different card or in cash. If you paid some or all of an order with a gift card the vendor accepts, that part goes back to the gift card; where the provider cannot do that automatically, the vendor refunds it through its own payment system.
6.4 Problems With Food
If something is wrong with the food, tell the vendor at the time. The vendor is responsible for the quality, safety, and description of what it sells, and it is the vendor who can put it right.
7. Accounts
You do not need an account to order. If you create one, you agree to:
- provide a real name and an email address you control, and keep them up to date,
- keep your password private and tell us if you believe someone else has used your account,
- use one account for yourself and not share it.
You are responsible for everything done with your account. We may suspend or close an account that breaches these Terms, is used for fraud or abuse, or creates a legal or financial risk for Rink Fries or for a vendor. If we close your account, we will tell you why unless the law prevents us.
Vendor accounts, staff accounts, and the roles within them are governed by the Vendor Agreement.
8. What You May Not Do
You may not use Rink Fries to:
- place orders you do not intend to pay for or collect,
- use a card that is not yours or that you are not permitted to use,
- harass, threaten, or abuse a vendor, its staff, other customers, or Rink Fries,
- interfere with the site, probe it for weaknesses, or attempt to access data that is not yours,
- scrape the site or use automated tools to place orders,
- impersonate another person or misrepresent your relationship with a vendor or a venue,
- break the law or the rules of the venue you are in.
Our Acceptable Use Policy contains the full list. We may remove content, cancel orders, and suspend accounts to enforce it.
9. Content You Provide
Anything you enter into Rink Fries, such as special instructions, feedback, or a message to support, remains yours. You grant us permission to use it to operate the platform, fill your order, and improve the service. Do not send us anything you do not have the right to share. Menus, photos, descriptions, and vendor names belong to the vendors. The Rink Fries name, logo, and site belong to Rink Fries.
10. The Site Itself
We work to keep Rink Fries available and accurate, but we provide it as it is. We do not promise that it will always be available, error-free, or suited to a particular purpose. We may change, suspend, or withdraw a feature, and we may take the site down for maintenance. Where we can, we will do so outside busy hours.
11. Our Responsibility to You
To the extent the law allows, our total liability to you for anything arising from an order or from your use of Rink Fries is limited to the amount you paid through Rink Fries for the order in question. We are not liable for indirect or consequential loss, such as lost time, lost enjoyment of an event, or a missed opportunity.
Nothing in these Terms limits liability that the law does not allow us to limit, including liability for death or personal injury caused by our negligence, or your rights under consumer protection law in your province.
The vendor, not Rink Fries, is responsible for the food and drink it sells, including its quality, safety, allergen content, and fitness for consumption.
12. Your Responsibility to Us
If your breach of these Terms, your misuse of a card, or your unlawful use of the site results in a claim against Rink Fries or a vendor, you agree to cover the reasonable costs that result.
13. Privacy
How we collect and use your information is set out in our Privacy Policy, which forms part of these Terms.
14. Changes to These Terms
We may change these Terms. When we do, we will update the date at the top and post the new version on the site. If a change is material, we will notify account holders by email before it takes effect. Your continued use of Rink Fries after the effective date means you accept the new Terms. Each order is governed by the Terms in force when it was placed.
15. Law and Disputes
These Terms are governed by the laws of the Province of Nova Scotia and the federal laws of Canada that apply there. If a dispute arises, we would prefer to resolve it by discussion, so please email us first. If that fails, the courts of Nova Scotia have jurisdiction, and nothing in these Terms prevents you from using a consumer protection body in your province.
If any part of these Terms is found to be unenforceable, the rest continues to apply. If we do not enforce a term on one occasion, we may still enforce it later.
